Your right to cancel

If you are not entirely satisfied with the protection provided, you have a right to cancel the insurance policy you have purchased within 14 days of the date of issue or receipt of the terms and conditions, whichever is the latter provided you would not have lodged a claim under the policy. We will refund you the policy premium you have paid but not the government stamp duty. Notification in writing together with the original Certificate of Motor Insurance must be mailed to: Elmo Insurance Ltd, Abate Rigord Street, Ta' Xbiex XBX 1111.

If you do not exercise Your right to cancel within the 14 day period, you may still cancel the Policy by giving us 7 days notice in writing and returning to us your Certificate of Motor Insurance. You should also obtain authorisation from the Licensing and Testing Directorate. Then, (unless you have made a claim during the current period of insurance) we will calculate the charge for the expired portion of your insurance, using our short period rates (as indicated below) to the date we receive your Certificate of Motor Insurance and refund you any amount due to you.

Our right to cancel

We may cancel the Policy by complying with the formalities laid down by the existing Legislation. You must deliver the Certificate of Motor Insurance to us as prescribed by Legislation. If the Insurance Certificate is lost or destroyed, a declaration on oath must be made. When you comply with this procedure, a proportionate part of your premium will then be returned to you.

Choice of law & jurisdiction

These Terms and Conditions shall be governed by Maltese Law. By accessing the Site, you have accepted Maltese Law as the law governing the use of the Site.

The Courts of Malta shall have exclusive jurisdiction over all claims or disputes arising out of, or in relation to, or in connection with the Site and these Terms and Conditions.

Policy documents detail the law applicable to each contract of insurance.


The language we do business in is English hence, the contents of this website, the terms and conditions of the Motor Insurance Policy and any communication from us will be in English language.

Complaints procedure

Your complaints will be acknowledged by our Complaints Officer and a response will be sent to you within a maximum time period of ten working days. In the event that your complaint remains unresolved, you may also write to the Consumer Complaints Manager at the Malta Financial Services Authority. This will not prejudice any rights you may have at law including any right to institute legal proceedings.

You may also seek assistance from the Malta Insurance Association with whom this company is affiliated.

Procedure for the submission of claims

If you are involved in an accident you should contact our Motor Claims Department on +356 2343 0000 as soon as possible, to provide us with full details of the accident. One of our Claims Handlers will assist you accordingly

Every judicial notification or any other communication relating to a claim must be sent to us without delay. You or any person claiming indemnity under the Policy must also inform the Motor Claims Department if you or such persons know of any impending prosecution, inquest of inquiry involving anyone insured by the Policy. No negotiation, compromise, admission or refusal of any claim must be entered into without our consent.

In the event of any Theft or other criminal act which may give rise to a claim under the Policy, you or any other person claiming indemnity under the Policy must advise the police authorities immediately and cooperate with us to convict the offender.

We shall be entitled to:

  • Take over and conduct in your own name or in the name of anyone else insured by the Policy, the defence or settlement of any claim;
  • Take proceedings at EIL's own expense and for EIL's own benefit, but in your name, or in the name of anyone else insured by the Policy, to recover any payment which EIL has made or may make under the Policy;
  • Retain full discretion in the conduct of any proceedings and in the settlement of any claim; and
  • Expect full cooperation on any matter affecting this insurance from you and anyone else insured by the Policy.

Disclosing full facts

When you take out, renew or alter any policy, the information you supply to us is the basis on which your cover and premium are agreed. If that information is incorrect or anything changes, please let us know immediately as it could invalidate your policy or result in a claim not being paid. We reserve the right to contact you to enable us to carry out a condition report of your car. Remember you should always tell us about any change immediately. Please do not wait until your renewal.

Protection & compensation if the company becomes insolvent

The Protection and Compensation Fund is made up of contributions by locally licensed insurers and provides limited compensation to policyholders if one of these insurers becomes insolvent. Payments out of the fund are made to qualified persons as defined in the Protection and Compensation Fund Regulations 2003. Collection of information

We collect personally identifiable information, like names, postal addresses, credit card information, email addresses, etc., when voluntarily submitted by our visitors. SSL is currently the preferred method to securely transfer credit card and other sensitive data over the Internet. If your browser supports SSL, please select the Secure Mode option when confirming your insurance and your credit card and other personal details will be protected by this technology. If you are restricted by the capabilities of your browser then you can use the non-secure mode, but we recommend that you upgrade to the latest version of any browser to allow you peace of mind during any further transactions. At no point is your credit information being stored by our System.
